Expungement PC 1203.4

Under California Penal Code Section 1203.4, a defendant may withdraw a plea of guilty or no contest, reenter a plea of not guilty, and the case dismissed.

If the court grants the petition to dismiss, the individual no longer has a criminal record.

Who is eligible?

Anyone who has been convicted of a misdemeanor or felony that:

  • Successfully completed probation for the offense, AND
  • Either did not serve prison time or served time in state prison but would have served time in county jail had the crime been committed after Prop 47.
